Welcome to Saharamind (“Platform,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our tele-mental health services, website, applications, and related systems (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Nature of the Services
Saharamind provides a technology platform that enables users to connect with licensed mental health professionals through telecommunication tools including video, audio, and messaging. The Platform facilitates connections between clients and independent providers. Mental health professionals are independent practitioners and are not employees of the Platform unless explicitly stated. The Platform itself does not provide medical or clinical services.
2. Not for Emergencies
The Services are not intended for emergency situations.
If you are experiencing a crisis or emergency:
- Contact your local emergency number immediately
- Contact your nearest hospital or emergency service
- Use a recognized crisis hotline in your country
The Platform does not monitor messages in real time and cannot guarantee immediate response.
3. Eligibility
To use the Services, you must:
- Be at least 18 years old (or legal age in your jurisdiction), or have verified guardian consent
- Provide accurate and complete registration information
- Be legally permitted to receive tele-mental health services in your jurisdiction
- Not be prohibited from using digital health services under applicable law
- We reserve the right to verify eligibility at any time.
4. Account Registration and Security
You agree to:
- Maintain accurate account information
- Keep login credentials confidential
- Notify us immediately of unauthorized access
- Be responsible for all activity under your account
- We may suspend or terminate accounts suspected of misuse or fraud.
5. Provider Relationship
Mental health providers on the Platform:
- Operate independently
- Are responsible for their own clinical decisions
- Maintain their own licensing and compliance obligations
- Establish their own therapeutic relationship with clients
- The Platform does not control clinical methods, diagnoses, or treatment decisions.
6. No Guarantee of Outcomes
Mental health outcomes vary by individual. The Platform makes no guarantees regarding:
- Clinical improvement
- Treatment results
- Provider compatibility
- Response times
- Availability of specific therapists
7. Acceptable Use
You agree not to:
- Use the Services unlawfully
- Harass, threaten, or abuse providers or staff
- Share false or misleading medical information
- Attempt to access other users’ data
- Reverse engineer or disrupt the Platform
- Record sessions without explicit consent (where prohibited by law)
- Violation may result in suspension or termination.
8. Appointments and Communications
- Session scheduling is subject to provider availability
- Missed sessions may be charged according to the provider’s cancellation policy
- Communications through the Platform may not be continuously monitored
- Messaging features are not emergency channels
9. Fees and Payments
Where applicable:
- Fees are displayed before booking
- Payments must be made through approved payment methods
- Refund and cancellation rules are defined in the platform billing policy
- We may update pricing with notice
- Failure to pay may result in service suspension.
10. Privacy and Data Protection
Your use of the Services is also governed by our Privacy Policy.
We implement reasonable safeguards for health and personal data. However:
- No digital system is completely secure
- You acknowledge inherent internet risks
- You consent to electronic communication and data storage
- Providers may maintain separate clinical records as required by law.
11. Tele-Mental Health Consent
- By using the Services, you acknowledge and consent to:
- Receiving mental health services via telecommunication
- Potential technical limitations
- Possible confidentiality risks inherent in online communication
- Differences from in-person treatment
- You may withdraw telehealth consent at any time.
12. Technology Limitations
We do not guarantee:
- Uninterrupted service
- Error-free operation
- Compatibility with all devices
- Continuous platform availability
- We may perform maintenance or updates without notice.
13. Intellectual Property
All platform content, including:
- Software
- Branding
- Designs
Text and materials
are owned by or licensed to the Platform and protected by intellectual property laws.
Users may not copy, distribute, or modify platform materials without permission.
14. User Content
You retain ownership of content you submit, but you grant the Platform a limited license to:
- Store
- Process
- Transmit
- Display
such content solely for service delivery and legal compliance.
15. Third-Party Services
The Platform may integrate third-party services (payments, video tools, analytics). We are not responsible for:
- Third-party outages
- External privacy practices
- Third-party errors
Use of those services may be governed by separate terms.
16. Suspension and Termination
We may suspend or terminate access if:
- Terms are violated
- Fraud or abuse is suspected
- Legal compliance requires it
- Risk to users or providers is detected
- Users may discontinue use at any time.
17. Disclaimers
Services are provided “as is” and “as available.”
To the maximum extent permitted by law, we disclaim:
- Warranties of fitness
- Continuous availability
- Outcome guarantees
- Error-free performance
18. Limitation of Liability
To the extent permitted by law, the Platform shall not be liable for:
- Indirect or consequential damages
- Loss of data
- Emotional distress claims related to provider conduct
- Service interruptions
- Total liability shall not exceed the amount paid for Services in the prior [X] months.
19. Indemnification
You agree to indemnify and hold harmless the Platform from claims arising from:
- Misuse of Services
- Violation of Terms
- False information provided
- Illegal activity through your account
20. Governing Law
These Terms are governed by the laws of Nepal, without regard to conflict of law principles.
Disputes shall be resolved in the courts of Nepal, unless arbitration is specified.
21. Changes to Terms
We may update these Terms periodically. Continued use after updates constitutes acceptance.
